What is different about our service?
  • We don’t take royalties or ownership rights off you. You will add your own Paypal button/payment instructions to the listing so that you will receive all sale proceeds directly to your account or as specified by you. You will need to create a free PayPal business account if you wish to accept payments via PayPal. We will provide instruction on how to create your PayPal button. For an example listing, click here.

Anything I should know about?
  • eBook submissions in Microsoft Word format only (for conversion to EPUB or PDF format).
  • There are three options you can select for receiving eBook Proceeds: “PayPal – Your Own Business Paypal Button”; “Alternate – Purchaser to Contact the Author to arrange payment – bank deposit”; “Alternate – Purchaser to Contact the Author to arrange payment – other”.
  • You agree to your eBook being published in a shareable format, that is, without Digital Rights Management (DRM) that could control by technical means the use that could be made of your eBook. You accept the risks arising from your eBook being published in this way. One risk you accept is the eBook being passed off by another person/entity and separately published.
  • We don’t accept for publishing any books requiring classification by the Australian Classifications Board or any books which  have been classified. A useful guide about classifications can be found on the Australian Government website. To view this guide, click here. We ask that you do not send us any explicit pictures.
  • We reserve the right not to publish a book submitted to us for publishing. If this right is exercised, you will be issued with a refund. It is made clear that we will not publish works:
    • in a foreign language;
    • that is a calendar/magazine;
    • exceeding 10MB in size;
    • with a searchable publishing history in any format; and/or
    • incorporating audio/video elements (as opposed to link to such elements).
  • We give you the opportunity to review the EPUB or PDF file prior to publishing. If you are unhappy with the result, we will provide you with a refund.
  • If at any time prior to publishing you decide not to have book published on www.safesailing.com.au, you may notify us of your decision by email to andrew@safesailing.com.au. If this right is exercised, you will be issued with a refund.
  • To ensure that the publisher is not-of-pocket in relation to a refund, you agree to your refund being reduced by all the PayPal fees incurred by the publisher in relation to providing you with a refund.
  • To the extent permitted by law, we will publish your eBook for distribution on www.safesailing.com.au. Ongoing distribution will be at the discretion of the publisher. It is brought to your attention that the publisher will immediately remove your eBook from distribution where it is necessary for us to comply with a court or tribunal order or formal direction from government or regulatory authority. The publisher will also remove your eBook from distribution when we are provided with satisfactory evidence from a third party to the effect that your eBook contains defamatory material.
  • You have the right to request your eBook be removed from www.safesailing.com.au at any time for any reason. Your request must be by email to andrew@safesailing.com.au.
  • You have the ongoing right to distribute your eBook on other websites. We note that there is no guarantee that the eBook published by www.safesailing.com.au will be accepted for distribution by other entities. You agree to acknowledge and accept this risk.
  • You have the ongoing right to print your eBook in paper or other formats. We note that there is no guarantee that the eBook published by www.safesailing.com.au will be accepted for distribution by other entities. You agree to acknowledge and accept this risk.
  • If the publisher is compelled or required to submit your eBook for classification, you will be liable for the compliance costs of the publisher. Please do not submit a book to us requiring classification.
  • If the publisher is compelled or required by a government or regulatory authority to take particular action in relation to your eBook, you will be liable for the compliance costs of the publisher.
  • If requested by the publisher, you agree to provide documentation to the publisher to evidence your authority and/or permissions to submit the works for publishing.
  • You are required to keep your details up-to-date with us whilst your eBook is distributed by www.safesailing.com.au.
  • You have the right to request advertising information for your eBook be updated at any time. Your request must be by email to andrew@safesailing.com.au. Your request will be processed in a reasonable time. Your request will be rejected if it introduces obscene or offensive language.
  • You are solely responsible to ensure your submission does not breach the copyright or other right of any person/entity or defame another person or entity or breach any other law, civil or criminal. You are also solely responsible for ensuring the copyright details and publishing note/s attached to your submission meet your legal requirements. If you require advice relating to your situation, go visit your professional adviser.
  • You agree to have the publisher’s advertising label added to the end of the eBook:

  • Upon your eBook being published, you agree to the publisher depositing your eBook with the following libraries: the State Library of Queensland, the Parliamentary Library of Queensland, and the National Library of Australia (upon request of the NLA). In relation to the depositing of your eBook with the National Library of Australia, the publisher has agreed with the library in relation to eBooks deposited that ‘I [the publisher] allow the Library to make the Material [eBook] accessible within the premises of the Library. People may view the Material and make notes about it’. In relation to the depositing of your eBook with the State Library of Queensland, the publisher has imposed the following access restriction for all eBook publications deposited with the library: ‘Alternate access which restricts on-line use to within State Library’s building, thereby providing the same level of access as a print publication’. By accepting these terms and conditions, you agree to the National Library of Australia and the State Library of Queensland providing access to your eBook as previously mentioned.
  • Upon your eBook being published on www.safesailing.com.au, you agree to: 1) details of the eBook being added to the site’s eBook catalogue; 2) a download link being added to the Quick Download Index for free eBooks only; and 3) the author’s name, website and contact details (specified for public release) being added to the site’s author listing (currently not in existence but may be introduced in the future). You accept and acknowledge that information or links added pursuant to this term may only be later removed at the discretion of the publisher. You may request this information be removed by email to andrew@safesailing.com.au. Your request however will not be binding on the publisher. It is the current policy of the publisher to keep available to the public, past details of eBooks published.
  • The publisher is not responsible for the advertising, marketing or promotion of your eBook. You however agree to allow the publisher to advertise/market/promote publishing of your eBook using the APL-SS Bulletin newsletter, @andrewbird85 twitter account and the Safe Sailing facebook page. You will also agree to allow the publisher to advertise/market/promote publishing on any media or physical marketing platforms adopted for business use from time to time. You further agree to allow the publisher to advertise/market/promote your book on www.accesspointlaw.com.au. Advertising, marketing or promotion of your eBook is not an entitlement; it is at the absolute discretion of the publisher.
  • Whilst your eBook is being distributed on www.safesailing.com.au, you agree to the publisher sharing download & sales data to the public via its website. Download & sales data may be shared via a widget on the eBook advertising page, the site’s eBook Catalogue or via a Best Seller’s list published on the website. This before mentioned list does not exclusively list the means by which download & sales data may be shared on the website.
  • If a purchaser reports a problem with eBook file, device, reader, etc and requests a refund or otherwise has a complaint, you agree to comply with the Australian Consumer Law. You may be obliged at law to make a refund or offer an alternative product. If you require advice relating to your situation, go visit your professional adviser.
  • You agree to make your own enquires as to whether you are eligible to payments under any applicable lender’s right schemes. For details of the Commonwealth scheme, click here. It is expressly made clear that the publisher will not assist you in making any claim under a lender’s right scheme or equivalent scheme.

  • We have investigated the capabilities of our website and report that it may be possible for a third party to access eBook download files without payment. The recent password protection of download pages has to some extent alleviated this risk but we nevertheless wish to bring it to your attention. We make it clear that there is a risk that you may lose sale proceeds through third party access to eBook download files. You agree to acknowledge and accept this risk.
  • Upon your eBook being removed from this website, this agreement shall be at an end. Both parties agree that upon the ending of the agreement and subject to the publisher’s right to be indemnified remaining in effect pursuant to a later clause of this agreement, each party will have no recourse against the other except for outstanding compliance costs.
  • You agree that the publisher may assign the benefit and burden of this agreement to a third party or to an entity managed and/or controlled by the publisher.
  • You agree that the publisher may amend these Terms and Conditions at any time. If the publisher amends the Terms and Conditions, you further agree to be bound by the amended Terms and Conditions. It is made expressly clear that the publisher will not hold you to an amendment that is not fair and reasonable. If required, this clause is severable from the Terms and Conditions.
  • We agree to treat your eBook submission as confidential. This obligation expires upon the publishing of your book on www.safesailing.com.au. The obligation is ongoing for unpublished works and shall survive the ending of this agreement.
  • If a sample is published and later the full version is submitted for publishing, a separate new fee will be payable. The full version will be treated for all intents and purposes as a new book.
The Fine Print…
  • Except to the extent the law provides that liability may not be excluded, Safe Sailing(.com.au) is not under any liability to you arising from or in respect of any loss or damage (including consequential or indirect loss or damage or loss of profits) howsoever caused, which may be suffered or incurred or which may arise directly or indirectly in respect of eBook publishing/distribution services by the publisher to you (or in respect of legal letter or precedent publishing) or in the exercise of a right by Safe Sailing(.com.au) pursuant to these Terms and Conditions. You further agree to indemnify Safe Sailing(.com.au) and/or its agents against any claim, judgment or investigation which may arise in relation to the above mentioned services, to the full extent permissible at law (inclusive of damages, interest, costs, etc). It is made clear that this clause survives the ending, termination, frustration, etc of this agreement; you agree to and acknowledge the ongoing nature of this clause.
  • Certain legislation may imply conditions and warranties into these Terms and Conditions. To the extent that such conditions and warranties may lawfully be excluded, all such conditions and warranties are expressly excluded.
  • This Agreement is governed by the laws applying to the State of Queensland, Australia. Any dispute arising from the interpretation or operation of this Agreement which cannot be resolved through informal means is to be heard in a Queensland court or tribunal or an Australian federal court or tribunal. No exception applies.
